Terms of sale

1. Making an order and its entry into force

1.1. The order is made between the person who makes a purchase in the online store www.koreanna.ee (hereinafter referred to as the Buyer) and Anna Nazarenko FIE (registration number 16504346) (hereinafter referred to as koreanna.ee). Placing an order is tantamount to concluding a Purchase and Sale Agreement.

1.2 All users of koreanna.ee and / or guests who wish to purchase our products are subject to the terms of this agreement and the rights and obligations arising from the laws of the Republic of Estonia.

1.3. The buyer places an order electronically by adding the product to the virtual shopping cart.

1.4. The order is executed from the moment when the Buyer clicks on the “Confirm order” link and agrees to these Terms.

1.5. The Seller sends the Buyer an invoice for the completed order by e-mail. Invoices and orders are also visible to the client in the koreanna.ee client environment if the client is logged in with his username and password.

1.6. When filling out an order, we recommend that you be careful to avoid inaccuracies in the data and the quantity of ordered goods. The buyer is responsible for the correctness of his registered letter.

1.7. The order takes effect from the moment when the amount due according to the invoice has been received on the current account of koreanna.ee.

2. Price

2.1. All prices on the koreanna.ee e-shop page are in euros and include 22% VAT.

2.2.Koreanna.ee reserves the right to make changes to prices. If the Buyer managed to pay for his order before the seller changed the price, the new price does not apply to this Buyer in this case, therefore, the Buyer buys the goods at the price that was indicated on the site at the time of placing the order

2.3 Delivery within Estonia is free for orders over €35. Delivery to Latvia and Lithuania is free from 50€. Delivery to Finland is free from 70€.

3. Payment for goods

3.1 When paying for the goods, the Buyer has the right to choose the payment method that suits him. You can pay for the purchase using the services of the following Internet banks: Swedbank, SEB Pank, Luminor Pank, Coop Pank, LHV Pank. To confirm the order, the Buyer pays 100% of the cost of the goods.

3.2. The contract is considered concluded, and we proceed to fulfill the order immediately after the Buyer pays 100% of the cost of the goods.

3.3. The buyer pays for the goods according to the invoice sent by koreanna.ee through a bank link, by transfer or by credit card. The Seller reserves the right to cancel the order and invoice if the Buyer does not pay the invoice no later than within 5 (five) calendar days.

3.4. The buyer pays for the goods to the current account koreanna.ee in the bank specified in the invoice.

4. Transition to banking services

4.1 A fast and secure way to pay for your purchase is through the Internet Bank. After placing an order, the Buyer will be directed to the Internet bank of his choice to make a payment. There can see the pre-filled payment order, which will indicate the amount to be paid. The buyer confirms the payment and then clicks the “Back to seller” button.

 
5. Delivery of goods

5.1. Koreanna.ee completes the order and passes it on to its logistics partners after the entry into force of the sales contract (see point 1).

5.2. Orders within Estonia reach the destination specified by the buyer, as a rule, within 1-3 working days (and rarely up to 5-7 working days) from the date of entry into force of the sales contract. Orders to Latvia, Lithuania and Finland reach the destination specified by the buyer, as a rule, within 3-5 working days (and rarely up to 5-7 working days) from the date of entry into force of the sales agreement. (see paragraph 1.)

5.3. If the Buyer wishes to change the agreed place or time of receipt of the goods, he must notify koreanna.ee immediately prior to the arrival of the goods at the place.

5.4. We ship the ordered goods in Estonia via DPD, SmartPOST or Omniva.

5.5. In the event that an incorrect or unclearly specified destination address is not found, the Buyer is responsible for the delay of the goods. The accuracy and correctness of the data provided in the order depends on the prevention of delays and misunderstandings in the delivery of goods. Koreanna.ee is not responsible for delays and misunderstandings during the delivery of goods in the event that the delay and misunderstandings arose due to the fact that the Buyer provided inaccurate data when placing an order

5.6. We recommend that the Buyer recheck the packaging and quantity of the product. If the packaging or product is damaged in transit, it must be returned and replaced with a new, undamaged product with the packaging intact. Goods damaged during transportation are replaced by the Buyer with a new one if the goods (but not the packaging) are damaged. If it is not possible to replace the goods with a new one, we offer to pay the Buyer the cost of the damaged goods.

5.7 The buyer is responsible if he does not pick up the parcel from the postal machine on time. The shelf life in postal machines is 7 days. The package is automatically returned to Koreanna. In this case, the Buyer will reimburse the return costs borne by Koreanna. The refund to the Buyer’s account takes into account the deduction of the amount of the return parcel. Since this case does not qualify for a return.

6. Right to return goods

6.1 The buyer shall have the right to cancel the contract concluded in the Online Store within 14 days after the delivery of the order. 

6.2. The right to return the goods shall not apply to orders placed by a legal entity acting as the buyer. 

6.3.For the right to return the goods within 14 days to be exercised, the ordered items shall not have been used in any other way than for checking the content, properties and operable condition of the goods in the way such checking is allowed for testing goods in a regular store. 

6.4. In case the item has been used for any other purpose than checking its content, properties and operable condition or in case it displays signs if use or wear, the Online Store shall have the right to reduce the amount to be refunded proportionally to the reduction of the value of the item or to refuse to refund the amount paid for the item completely. 

6.5. To return the goods, the buyer shall file an application of withdrawal from the purchase of the goods, stating the details of the seller and the buyer and sending the application by e-mail to info@meliorabeautyshop.ee within 14 days from the delivery of the goods at the latest. The application form is available at https://www.riigiteataja.ee/akt/103012014001.

6.6. The cost of the return shall be covered by the buyer except for cases when the reason for returning the goods lies in the fact that the item being returned does not correspond to what has been ordered (for instance, a wrong item or faulty item). 

6.7. The buyer shall return the goods within 14 days after filing the application or submit a proof of forwarding the goods to the delivering party within the said period. 

6.8. Upon receiving the goods being returned, the Online Store shall refund all the contractual expenses of the buyer without delay but no later than within 14 days. 

6.9. The Online Store shall have the right to refuse to refund the payments until the item which is the object of the contract has been received or until the buyer has submitted a proof of the fact that the item has been shipped back to the store, whichever is earlier. 

6.10. If the buyer has unambiguously selected the delivery method which is more expensive than the standard cheapest method of delivery of items, the Online Store shall not be obliged to refund the expense which exceeds the standard cost of delivery to the customer. 

6.11. The Online Store shall have the right to cancel the sales and purchase transaction and demand that the buyer return the item in case a price which significantly lower than the market price of the item has been by mistake stated in the Online Store. 

7. Goods with a defect

7.1. Under the terms of the contract, the Online Store shall bear responsibility for non-conformities or faults in the item delivered to the buyer which exist at the moment of the transfer of the item to the buyer or are identified within two years after the transfer of the item to the buyer. Within the first six months after the transfer of the item to the buyer, the fault shall be deemed to have existed at the moment of the transfer of the item. It is the obligation of the Online Store to disprove the above presumption. 

7.2. Upon discovering a fault, the buyer shall have the right to contact the Online Store within 14 days at the latest by sending an e-mail to info@koreanna.ee. 

7.3. The Online Store shall bear no responsibility for any faults which occurred after the item was transferred to the buyer. 

7.4. If an item purchased in the Online Store displays a fault for which the Online Store bears responsibility, the Online Store shall repair or replace the faulty item. In case the item cannot be repaired or replaced, the Online Store shall refund all the expenses incurred by the buyer under the sales and purchase contract. 

7.5. The Online Store shall respond to the customer’s complaint in writing or a format which can be reproduced in writing within 15 days.

8. Processing of personal data of the Buyer

8.1. When making a purchase through koreanna.ee and for the purpose of making it, the Seller collects the following data about the Buyer: name and surname, address (when using the courier service), telephone number, bank account number, e-mail address.

8.2. The Buyer’s personal data is collected and processed for the following purposes:

  • first and last name – for order delivery and order management;
  • address – for order delivery by courier service;
  • telephone number – for the delivery of an order via a parcel delivery service and/or a courier service, as well as for sending direct marketing materials;
  • e-mail address – to manage the order and to deliver the order through the parcel delivery service and / or courier service, as well as to send direct marketing materials;
  • bank account number – to manage the order and to return payments to the Buyer.
  • The e-shop visitor’s IP address or other online identifiers – for the provision of e-shop services as an information society service, as well as for compiling site visit statistics.

8.3. More detailed information regarding the processing and security of personal data can be found in the Privacy Policy of koreanna.ee.

9. Other terms

9.1. Koreanna.ee shall not be liable for any damage caused to the Buyer or for a delay in the delivery of the goods in the event that the damage or delay in the delivery of the goods is due to a circumstance that koreanna.ee could not influence and the occurrence of which koreanna.ee did not foresee and could not foresee (irresistible force).

9.2. Koreanna.ee resolves misunderstandings with its customers amicably and through negotiations.

9.3. If the parties still cannot find a suitable solution, each party has the right to apply to the Consumer Protection Board, the Consumer Dispute Resolution Commission or the Harju County Court.

9.4. The Seller draws the attention of the Buyer to the Internet-based dispute resolution platform (so-called ODR platform) in accordance with Regulation of the European Parliament and of the Council No. 524/2013 on Internet-based consumer dispute resolution. First of all, the Internet-based dispute resolution platform is designed to resolve cross-border disputes, making it easier for the consumer buyer to find a suitable out-of-court institution to resolve a particular dispute in the seller’s member country. The ODR platform can be found at: http://ec.europa.eu/consumers/odr/.

9.5. In turn, koreanna.ee also has the right to apply to the Court for the protection of its rights.
